In those cases, the Telema client is the data controller, and our processing is governed by our agreement with the client and applicable law.<\/p>\n\n\n\n<p>Where Telema processes personal data on behalf of a customer as a processor, any applicable Data Processing Agreement, agreement, or other documented terms governing that processing will take precedence over this Privacy Policy to the extent of any inconsistency.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. You can object or unsubscribe at any time. For marketing cookies\/trackers we rely on consent.<\/li>\n\n\n\n<li><strong>Comply with the law<\/strong><br>To meet legal and regulatory requirements (for example, accounting or responding to lawful requests from authorities).<br><em>Legal basis: <\/em>legal obligation.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">1.3 How long we keep this data<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Web server logs:<\/strong> normally up to <strong>12 months<\/strong>, unless we need them longer for security or legal reasons.<\/li>\n\n\n\n<li><strong>Website forms and enquiries:<\/strong> generally up to <strong>3 years<\/strong> after our last interaction with you, unless we need to keep them longer for legal claims or as required by law.<\/li>\n\n\n\n<li><strong>Cookies:<\/strong> for the period specified in our cookie banner or in the settings of each cookie (see Section 5).<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. If you represent a client (for example as a contact person or user of Telema services), we may process personal data about you, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Identification and contact details<\/strong> \u2013 name, personal ID, business e\u2011mail, business phone number, employer, job title or role.<\/li>\n\n\n\n<li><strong>Contract and account data<\/strong> \u2013 contract details, service subscriptions, account IDs, billing and payment data, configuration details, support history.<\/li>\n\n\n\n<li><strong>Communication data<\/strong> \u2013 e\u2011mails, meeting notes and other correspondence related to our services.<\/li>\n\n\n\n<li><strong>Usage data<\/strong> &#8211; interactions with features and services in form of analytical data and screen recordings, client session data, log-in attempts, device type, browser and IP address.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">2.2 Why we use this data<\/h4>\n\n\n\n<p>We use this data to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Provide, manage, improve, and protect Telema services<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Conclude and execute contracts, create and manage accounts, deliver and enhance services, handle support requests, and protect our services by monitoring for suspicious activity and preventing abuse (for example, blocking IP addresses).<br><em>Legal basis:<\/em> performance of contract with the client and steps taken before entering into a contract.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Manage customer relationships<\/strong><br>To keep track of our relationships with clients and prospects, handle feedback and improve our services.<br><em>Legal basis:<\/em> our legitimate interests in running and developing our business.<\/li>\n\n\n\n<li><strong>Send service\u2011related information and B2B marketing<\/strong><br>To send important notices about the services you use and other information about Telema solutions that may be relevant for your business.<br><em>Legal basis:<\/em> our legitimate interests in B2B communication and marketing. You can opt out of marketing messages at any time.<\/li>\n\n\n\n<li><strong>Meet legal obligations<\/strong><br>To comply with accounting, tax and other legal requirements.<br><em>Legal basis:<\/em> legal obligation.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">2.3 How long we keep this data<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contracts, billing and related records:<\/strong> at least <strong>7 years<\/strong> from the end of the relevant financial year or as required by accounting and tax laws.<\/li>\n\n\n\n<li><strong>CRM and support data:<\/strong> normally up to <strong>3 years<\/strong> after the end of the client relationship, unless we need it longer to protect our rights or comply with the law.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">3. When you apply for a job at Telema (candidates)<\/h2>\n\n\n\n<h4 class=\"wp-block-heading\">3.1 What data we collect<\/h4>\n\n\n\n<p>For recruitment, we may process:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>name and contact details;<\/li>\n\n\n\n<li>CV and other information about your education, skills, qualifications and work experience;<\/li>\n\n\n\n<li>information from interviews and tests;<\/li>\n\n\n\n<li>references you provide;<\/li>\n\n\n\n<li>publicly available professional information (for example, LinkedIn profile).<\/li>\n<\/ul>\n\n\n\n<p>We receive this data:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>from you directly (applications, CVs, cover letters, interviews);<\/li>\n\n\n\n<li>from recruitment or professional networking platforms;<\/li>\n\n\n\n<li>from recruitment service providers;<\/li>\n\n\n\n<li>from references you have indicated or otherwise authorised us to contact.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">3.2 Why we use this data<\/h4>\n\n\n\n<p>We use candidate data to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Run recruitment processes<\/strong> \u2013 review applications, interview candidates and make hiring decisions.<br><em>Legal basis:<\/em> our legitimate interests in recruiting and selecting employees.<\/li>\n\n\n\n<li><strong>Keep promising candidates in mind for future roles<\/strong> \u2013 if you agree, we may keep your data for future opportunities.<br><em>Legal basis:<\/em> your consent (where required).<\/li>\n<\/ul>\n\n\n\n<p>We may use automated tools (for example, filters in LinkedIn or other platforms based on criteria like education or work\u2011permit status) to pre\u2011screen candidates. Final decisions are not made solely by automated means \u2013 there is always human review.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">3.3 How long we keep candidate data<\/h4>\n\n\n\n<p>If you are not selected:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>we keep your data for <strong>up to one (1) year<\/strong> after the end of the recruitment process to protect our legitimate interests (for example in case of disputes);<\/li>\n\n\n\n<li>if we wish to keep your data longer to contact you about future positions, we will ask for your <strong>explicit consent<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>You can withdraw consent at any time. After withdrawal, we will delete your data unless we must keep it to comply with the law or to establish, exercise or defend legal claims.<\/p>\n\n\n\n<p>Access to candidate data is restricted to people involved in recruitment (e.g. hiring managers, HR, relevant management), all bound by confidentiality.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. When Telema acts as data processor for clients<\/h2>\n\n\n\n<p>When a client uses Telema solutions to process personal data (for example, data about its customers or trading partners), Telema acts as a <strong>data processor<\/strong> and the client is the <strong>data controller<\/strong>.<\/p>\n\n\n\n<p>In such cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the client decides why and how the personal data is processed;<\/li>\n<\/ul>\n\n\n\n<p>processing terms are governed by our agreement with the client and applicable law;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Telema processes personal data only on the client\u2019s documented instructions and in compliance with GDPR.<\/li>\n<\/ul>\n\n\n\n<p>If there is any difference between this Privacy Policy and the client-specific terms for such processing, our agreement with the client and applicable law will prevail.<\/p>\n\n\n\n<p>As a processor, Telema:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>applies suitable technical and organisational security measures;<\/li>\n\n\n\n<li>ensures people handling data are under confidentiality obligations;<\/li>\n\n\n\n<li>uses sub\u2011processors only as allowed by our agreement with the client and applicable law;<\/li>\n\n\n\n<li>assists the client in responding to data subject requests and in meeting its legal obligations (for example, data breach notifications), as set out in our agreement with the client and applicable law;<\/li>\n\n\n\n<li>deletes or returns personal data at the end of the services, including handling of backups and logs as described in our agreement with the client and applicable law.<\/li>\n<\/ul>\n\n\n\n<p>If data is transferred outside the European Economic Area (EEA) on behalf of a client, Telema applies the transfer mechanisms agreed with the client (for example EU Standard Contractual Clauses and any necessary supplementary measures).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Information about sub\u2011processors is available to clients as described in our agreement with the client and applicable law [or via a separate sub\u2011processor list, if applicable].<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Data security<\/h2>\n\n\n\n<p>We take security seriously. Telema applies appropriate technical, physical and organisational measures to protect personal data against loss, misuse, unauthorised access, disclosure or destruction.<\/p>\n\n\n\n<p>These include, but are not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>access control and the principle of least privilege;<\/li>\n\n\n\n<li>encryption in transit and at rest where appropriate;<\/li>\n\n\n\n<li>secure development and change management processes;<\/li>\n\n\n\n<li>logging and monitoring;<\/li>\n\n\n\n<li>backup and recovery procedures;<\/li>\n\n\n\n<li>locked storage for confidential documents;<\/li>\n\n\n\n<li>confidentiality obligations and training for staff.<\/li>\n<\/ul>\n\n\n\n<p>Security measures are regularly reviewed and updated.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. Your rights<\/h2>\n\n\n\n<p>Under data protection law, you have various rights regarding your personal data, subject to certain conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Right of access<\/strong> \u2013 to know whether we process your personal data and, if so, to receive a copy and related information.<\/li>\n\n\n\n<li><strong>Right to rectification<\/strong> \u2013 to have inaccurate or incomplete data corrected.<\/li>\n\n\n\n<li><strong>Right to erasure (\u201cright to be forgotten\u201d)<\/strong> \u2013 to request deletion of your data in certain cases (for example, if it is no longer needed and there is no legal basis to keep it).<\/li>\n\n\n\n<li><strong>Right to restriction of processing<\/strong> \u2013 to request we limit the processing of your data in certain situations (for example, while a complaint is investigated).<\/li>\n\n\n\n<li><strong>Right to data portability<\/strong> \u2013 where processing is based on <strong>consent<\/strong> or <strong>contract<\/strong> and carried out by automated means, to receive your data in a structured, commonly used, machine\u2011readable format and to have it transmitted to another controller where technically feasible.<\/li>\n\n\n\n<li><strong>Right to object<\/strong> \u2013\n<ul class=\"wp-block-list\">\n<li>to processing based on our <strong>legitimate interests<\/strong>, on grounds relating to your particular situation;<\/li>\n\n\n\n<li>to <strong>direct marketing<\/strong> at any time (including related profiling).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Right to withdraw consent<\/strong> \u2013 if we rely on consent, you can withdraw it at any time. Children and automated decisions<\/h2>\n\n\n\n<p>Telema\u2019s services are not directed at children under 16, and we do not knowingly collect or process personal data about children. Clients and users should not provide personal data of children when using our services.<\/p>\n\n\n\n<p>Telema does <strong>not<\/strong> use personal data for profiling or for making decisions based solely on automated processing that produce legal effects or similarly significant effects for individuals.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11.
